1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the RSA eCommerce website and cross border logistics services provided by RSA eCommerce, a division of RSA Global ("we", "us", or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Services

RSA eCommerce provides cross border eCommerce delivery services, including:

• Destination customs clearance and compliance management.
• Last-mile delivery across 40+ countries.
• Shipment tracking and visibility.
• SLA management and issue resolution.

Services are provided on the basis of a separate commercial agreement between RSA eCommerce and the client. These Terms supplement any such agreement, and in the event of conflict, the commercial agreement shall prevail.

3. Client Responsibilities

As a client of RSA eCommerce, you are responsible for:

• Providing accurate and complete shipment information, including customs declarations, item descriptions, and consignee details.
• Ensuring that all goods shipped comply with applicable export laws, import regulations, and prohibited/restricted goods lists of both origin and destination countries.
• Managing first-mile collection and international linehaul to designated handover points.
• Maintaining valid and current commercial documentation as required.

4. Prohibited Goods

You may not ship goods that are illegal, prohibited, or restricted under the laws of the origin or destination country. This includes but is not limited to hazardous materials, controlled substances, weapons, counterfeit goods, and items subject to international sanctions. RSA eCommerce reserves the right to refuse, return, or dispose of any prohibited shipment at the shipper's expense.

5. Customs and Compliance

RSA eCommerce facilitates destination customs clearance on behalf of clients. However, the ultimate responsibility for the accuracy of customs declarations and compliance with import/export regulations rests with the shipper. RSA eCommerce is not liable for delays, penalties, or seizures resulting from inaccurate or incomplete documentation provided by the client.

6. Service Levels and Liability

RSA eCommerce endeavours to meet agreed service levels for delivery timelines and performance. However:

• Delivery timelines are estimates and not guarantees, unless explicitly stated in a commercial agreement.
• RSA eCommerce shall not be liable for delays caused by customs holds, force majeure events, carrier disruptions, incomplete documentation, or circumstances beyond our reasonable control.
• Liability for loss or damage to shipments is governed by the terms of the applicable commercial agreement and subject to the limitations set out therein.

7. Pricing and Payment

Pricing for services is set out in the commercial agreement between RSA eCommerce and the client. All invoices are payable within the terms specified in the agreement. RSA eCommerce reserves the right to suspend services for overdue accounts.

8. Intellectual Property

All content on the RSA eCommerce website, including text, graphics, logos, software, and design, is the property of RSA eCommerce or RSA Global and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

9. Website Use

When using our website, you agree not to:

• Use the website for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the website or its systems.
• Interfere with the proper functioning of the website.
• Use automated tools to scrape, crawl, or extract data from the website without permission.

10. Limitation of Liability

To the maximum extent permitted by law, RSA eCommerce and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website. Our total liability shall not exceed the fees paid by you for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless RSA eCommerce, RSA Global, and their officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses arising from your breach of these Terms, your use of our services, or your violation of any applicable law or regulation.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of our services or website after changes are posted constitutes your acceptance of the revised Terms.
